April 11, 2026: On April 7, 2025, the City of Seattle Department of Construction & Inspections (SDCI) Code Compliance Division cited the Applicant with a Shoreline Violation (Record Number 1060659-VI) for a series of unauthorized exterior developments conducted within the steep-slope hazardous area and shoreline jurisdiction (the shoreline jurisdiction encompasses the entire subject property) associated with Elliott Bay (Puget Sound). The cited unauthorized developments included installation of a new staircase, modifications to the bulkhead and the area landward of the bulkhead, excavation at the toe of the slope, vegetation removal, and placement of cement (impervious) surfaces behind the bulkhead. However, several components of the unauthorized development are expected to be considered repair or maintenance of existing structures, as the previously existing features were no longer safe for continued use and were replaced within their original development footprints. These elements include the replacement wooden staircase along the southern western portion of the subject property and the replacement of the landscaping wall located landward of the bulkhead. Additionally, based on the geotechnical assessment provided by Migizi Group, Inc. (MGI), the completed unauthorized work has not adversely affected slope stability or contributed to slope erosion at the subject property. Accordingly, the Applicant is pursuing after-the-fact authorization through the shoreline variance permitting pathway for the completed work within the shoreline jurisdiction. The Applicant remains committed to ensuring that the overall project results in no net loss of shoreline ecological function compared to pre-project conditions and anticipates that the proposed actions will achieve a net gain in shoreline ecological function.
