March 3, 2022: JK Pool. The scope of work is to install an underground pool and ADU pool house that will be located within the setbacks in the flatter portion of the back yard at the NE angled property line. Excavated dirt will be kept and relocated on site as much as possible to the north end of the property provide retention and drainage as required. The existing carport will be enclosed and hopefully expanded to a garage. 
City staff has told us a 50 foot buffer from the top of creek bank. I have attached the survey we had completed recently and as you can see a good size chunk of both ends of the house and almost the entire carport is less than 50 feet from the creek bank. This survey shows a 15 foot setback line from the top of creek bank per the original short plat of the lot. In addition the homeowner has also shared that there are homes that are starting construction below him and down stream in the creek that appear to be constructed much less than 50 feet from the creek bed. 

With this conflicting information we want to get confirmation on what the current setback limitations are so that we can plan our next steps. 

In addition to that question we would like to get any feedback you have on our proposed project.
