July 2, 2025: RVA Permissions. Land Use Code regarding RVAs was repealed in 2006. (19 years ago). Lakemont PLATs require written permission from the city for ANY pruning etc. in an RVA. The city interprets written permission as a permit The city lumped RVAs into critical areas for permitting purposes which suggests a GJ permit which has a 1686 dollar land use review charge. While routine maintenance and pruning is allowed in critical areas without obtaining a permit (BCC 23.76.035(B)(2)), that exception does not address the PLAT requirement for written permission (#2 above). As a result, maintaining our backyards - even mowing the lawn - costs 2000 per event. Note that the fee is dependent on the permit type. Since 2018, there have been 12 permit applications for RVA maintenance. Half of them (6) were GA permits with an average fee of 458 and half (6) were GJ permits with an average fee of 1369. There does not appear to be any reason why one permit type was chosen over another. There are 48 RVAs spread across 64 lots within Lakemont that are impacted.
